By accessing or using hudgensmd.com (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site. The Site is operated by Dermatology and Skin Cancer Center (the "Practice").
2. Medical disclaimer
The Site is for general informational purposes and does not provide medical advice. Content on the Site, including descriptions of conditions, procedures, and treatments, is intended to help you understand dermatologic care, not to diagnose or treat any specific condition.
Always consult a licensed physician for medical advice specific to you. If you have or suspect a medical problem, contact a qualified healthcare provider promptly. Never delay seeking care, ignore professional advice, or stop a prescribed treatment because of something you read on the Site.
Reading content on the Site, contacting us through the contact form, or interacting with the Site in any way does not create a doctor-patient relationship. A doctor-patient relationship is established only when you become a patient of the Practice through the standard intake and visit process.
For medical emergencies, call 911 or go to the nearest emergency room.
3. Permitted use
You may use the Site to learn about the Practice, our services, and how to schedule a visit. You agree not to:
- Use the Site for any unlawful purpose or in any manner that could damage, disable, or impair the Site;
- Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site;
- Use automated tools (scrapers, bots, etc.) to extract data from the Site, except where allowed by our
robots.txt; - Reproduce or distribute Site content without permission, beyond fair use;
- Submit false, misleading, or harmful information through the contact form.
4. Information you submit
When you submit an appointment request through the contact form, you grant the Practice the right to use the information you provide to respond to and follow up on your request. We treat your information per our Privacy Policy.
Do not include detailed medical history, symptoms, or other Protected Health Information in the contact form. The form is not a HIPAA-secured channel. For PHI, use the patient portal or call the office.
5. Intellectual property
The Site, including text, graphics, logos, images, and software, is owned by the Practice or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Brand names of products mentioned on the Site (e.g., BOTOX®, Juvéderm®) belong to their respective owners and are used to identify those products only.
6. Third-party links
The Site may link to third-party websites (e.g., the patient portal, Google Maps, payment processors, manufacturer information pages). We do not control these sites and are not responsible for their content, policies, or practices. Following a third-party link is at your own risk and subject to that site's own terms.
7. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, the Practice and its physicians, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Site, even if advised of the possibility of such damages.
Nothing in this section limits liability that cannot be limited under applicable law (including liability for medical malpractice arising from the doctor-patient relationship, which is governed separately by the standard of care and applicable Florida law).

You agree to indemnify and hold harmless the Practice and its physicians, employees, and agents from any claim or demand, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.
10. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.
11. Changes to these terms
We may update these Terms from time to time. We'll post any changes here with an updated effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.
